Bergman & Associates ("Bergman") has a long-standing commitment to safeguard the privacy of information entrusted to us.  The privacy principles and procedures set forth below are intended to tell you how we collect, use, and distribute user information via our primary public web site (www.PresentWithEase.com).  This statement also applies generally to all web sites operated by Bergman (and its affiliates).  This statement does not cover information collected from sources other than Bergman's web sites.

Types and Uses of Personal Information

If you use this web site, personally identifiable information about you may be collected and processed by Bergman's employees.  In general, we only collect such information (such as your name, address, phone number, e-mail address, and type of business) when you knowingly provide it to us.  Additionally, Bergman may automatically collect or process personally identifiable data (such as your Internet domain or IP address) as part of the operation of this web site or during the course of your activities on or use of this web site.  In nearly all cases, this data may be collected or processed by, and transferred to, Bergman's facilities in Canada and the United States and in other countries where Bergman does business; the data is then subject to the legal systems of those countries.  This may be done through the site's Internet Service Provider (ISP) or through the use of such tools as Google Analytics.  This information includes (but may not be limited to) the Internet Protocol (IP) address of your computer, your browser type, the language and location of your computer and/or browser, the date and time you visited the site, and the pages you visited.  This information is gathered to improve the quality of our services and our ability to market those services to specific individuals and organizations that could benefit from them.

By using this web site (which resides in part on servers located in Toronto, Canada), you unambiguously consent to any collection, processing, transfer or use of any personal data.  If you do not consent to any collection, processing, transfer, or use of such information, please discontinue use of this web site.

Collecting and Using Information—AtEaseWithTheMedia.com

If you use an organization's access to sign up for the AtEaseWithTheMedia.com training program (located specifically at www.AtEaseWithTheMedia.com), we collect certain information from you ("Registration Information").  Registration Information may include your name, title, street address, city, state, country, postal code, telephone number, and e-mail address, and any other information useful to our services.  Registration Information is generally used to manage access to the training program, and ensure we maintain up-to-date records of those who have successfully completed it.

Bergman may share your name and e-mail address with affiliates or business partners of Bergman & Associates in relation to specific presentation skills or media training services that you and/or your organization have requested.

If you used an organization's access, (the "associated organization"), Bergman & Associates will verify to that organization you have completed the online version of At Ease With the Media when asked, but will not provide specific test results (i.e. whether you scored 45 out of 50 to earn your Certificate of Completion or 50 out of 50) and will not provide information on any re-takes of quizzes that may have been required to earn your Certificate of Completion for this program, unless such information is specifically requested by the associated organization, whether after completion of a training program or module or as part of the preexisting agreement between Bergman and the associated organization.

Bergman & Associates does reserve the right to use your registration information to contact you directly to verify that you are respecting the Bergman's Copyright Agreement, Non-Disclosure Agreement and License Agreement, if applicable.  We reserve the right to contact you to provide reminders to complete the program within the time frame indicated by your organization (if necessary).  We may also contact you to remind you that your organization's subscription (or your personal subscription) to the AtEaseWithTheMedia.com website is coming due and to ask whether you would like to renew that subscription.

Sharing With Affiliates, Parties and Suppliers of Services for Bergman Companies

We may share our data, including personally identifiable information about you, with our affiliates, partners, and companies or individuals who provide services on behalf of Bergman throughout the world.  To the extent that these entities have access to your information, they will have agreed with Bergman to follow privacy practices no less protective than our practices described in this document, to the extent allowed by applicable law.

How Personal Information Is Shared With Third-Parties

Generally, and except as indicated at the time of collection, Bergman will not sell, trade, or disclose your personally identifiable information to third parties that want to market products to the user, without your consent.  However, Bergman may disclose information to third parties assisting us in carrying out a transaction or providing a service for you (e.g., packaging, sending and delivering purchases and information to you, clearing credit card transactions, or performing statistical analyses of our services, performing promotional services and training services), or in connection with merger and acquisition discussions.  Additionally, Bergman may disclose information when required by subpoena, search warrant, or other legal process, or in response to activities that are unlawful or a violation of Bergman's rules for use of the web site, or to protect and defend the rights or property of Bergman.

Other Uses Of Information

Occasionally, Bergman may also use the information Bergman collects to notify you about important changes to the web site, new services and offers Bergman thinks you might find valuable.  Individuals and organizations who do not wish to receive those mailings or materials (whether e-mail or paper mail) or who believe they are receiving those mailings by mistake can contact Bergman (as described below under Contact Information) and request removal from the mailing list.  Notwithstanding anything to the contrary in this Privacy Policy or elsewhere on this web site, Bergman reserves the right to share any information you submit with affiliates or, in connection with the sale, assignment, or other transfer of the business of this web site and/or Bergman.

Security Measures

Bergman has implemented commercially reasonable technological and operational security processes to protect your personally identifiable information from loss, misuse, alteration, or unintentional destruction.  While no security measure can guarantee against compromise, Bergman regularly reviews and updates its security measures in an effort to provide appropriate security for all information held by Bergman.

Voluntary Surveys

From time to time we may conduct surveys with participants of the online AtEaseWithTheMedia.com training program.  These surveys are voluntary and you may opt out of being contacted at any time.  However, by participating, you are helping us to improve the training experience for participants of future versions of AtEaseWithTheMedia.com.

Legal Disclosure

On the secure portion of the AtEaseWithTheMedia.com website, your login information and password are considered confidential.  However, this information may be shared if it is necessary to comply with applicable laws, or to assist law enforcement officials and/or the court and judicial systems.

Use of Cookies

Bergman may use "cookies" in connection with operation of its web sites.  Cookies are small pieces of information that are stored on your computer by the Bergman's web site server.  Cookies are used for record-keeping purposes: the stored information can be retrieved by the Bergman's web site server when you return to the web site.  This allows Bergman to personalize or regulate the use of the site, and also permits Bergman to automate the access and data-entry functions of the site (e.g., login information), to store on-line ordering information for purchases you may make while visiting the site, and to tailor the appearance or presentation of the site to your preferences or interests.  In general, we do not use cookies to track the navigational habits of identified users without the user's consent.  If you visit our sites only to read or download content, much of the information we do collect is statistical only (e.g., the domain from which you access the Internet, the date and time you access our site, and the Internet address of the web site from which you linked directly to our site) and not personally identifiable.  We use this information about the number of visitors and their use of the sites in aggregate form to make our sites more useful and attractive to you.

The use of cookies is common in the industry, and they are used at most major web sites.  Cookies will not be used to pass any information from your computer except the specific information placed into the cookie from one participating Bergman's web site when the cookie is retrieved by another participating Bergman's web site.  You may wish to adjust your Web browser to inform you whenever a cookie is to be used, or to reject all cookies automatically.  However, if you elect not to accept cookies, some parts of the web site may not function properly or permit access.  For more information on cookies, see http://www.cookiecentral.com/faq.htm.
